The Indian judiciary has played a pivotal and transformative role in shaping the legal framework for women's safety across decades of constitutional interpretation and landmark jurisprudence. This empirical paper examines the evolving judicial posture toward women's safety in India through a systematic comparative legal analysis of landmark judgments delivered by the Supreme Court and various High Courts from 1985 to 2023. The study employs a mixed-methods approach combining doctrinal legal analysis with quantitative data derived from judicial records, crime statistics published by the National Crime Records Bureau (NCRB), and legislative response timelines. Data collected from 847 judicial decisions, 38 years of crime statistics, and legislative amendments reveal a complex but progressively assertive judicial intervention pattern in cases involving sexual violence, domestic abuse, workplace harassment, and matrimonial disputes. Statistical analysis demonstrates a measurable correlation between landmark judicial pronouncements and subsequent reductions in specific categories of gender-based crimes, though systemic implementation challenges persist. Comparative analysis with international judicial frameworks further illuminates India's unique constitutional approach to women's safety. The findings suggest that while judicial activism has significantly strengthened women's legal protections, gaps in enforcement, socioeconomic barriers, and inconsistent lower court compliance continue to undermine the full realization of judicial intentions. |
